Legal information, Delivery terms, Sale conditions.
1. OBJECT OF THE DOCUMENT :
Provisions defined below, constitute a contract establishing the remote conditions of sale of the products of the e-commerce site of the CALAIS-LINGERIE company, and that between the CALAIS-LINGERIE wholesaler registered in France, and the customer, particular, consuming products sold on the Web site.

3. CUSTOMER RIGHT:
Information requested from the customer, necessary to the treatment of his order and his follow-up, could not be communicated to a third. In accordance with the law `informatique et liberté' of January 6 of 1978, the customer can be opposed to any disclosure of his personal data, and has access and correction of his recorded data right on the site. To exert this right, please contact: commandes@calais-lingerie.com. This computerized treatment of information was the declaration object at the CNIL.
4. PRICE:
Prices are indicated in euros all inclusive of tax. The prices are those in force at the day of the order. They take account of VAT rate applicable to the day of the order. Any change of VAT rate will be reflected automatically on the prices.
5. ORDER :
To pass an order via the site implies the whole and irrevocable adhesion of the customer in the present conditions of sale. Any order by the customer constitutes an acceptance of prices, and of the product such as it is defined on the site. The sale will be regarded as final after the sending to the customer of the confirmation of its order by CALAIS-LINGERIE and cashing of CALAIS-LINGERIE of the entirety of the price. The system of recording of the site is regarded as sale contract, dated from the date of the site registration. CALAIS-LINGERIE it is committed delivering the orders received on the site only within the limit with stocks available. In the absence of availability of the product, CALAIS-LINGERIE is committed informing the customer as fast as possible. In the event of unavailability of the product, the customer will be informed and will have the possibility of cancelling his order. He will have the choice between exchange of the product against a same value product or a suggested product by CALAIS-LINGERIE, or the emission of 1 year valid purchase order in all the CALAIS-LINGERIE catalogue, or a refunding of the committed sum which will be carried out in the 30 days as from the date of the order.
6. METHODS OF PAYMENT :
1- Credit card
The validation of the order by means of the banking card number and its scratch date is worth mandate to pay the entire amount of the order. The relative data with this bank card are preserved only during the processing time of this order.
2- By bank check
Payments can be carried out by cheque in euros, only issued by one French banking institution, with order CALAIS-LINGERIE and with the number of this order to the back.
The bank check must be sent to the address:

The order will be validated only after reception and cashing of this bank check.
7. CRYPTOLOGY
CALAIS-LINGERIE guarantees the means and services of Cryptology used to make safe the transactions, which made the object of an authorization and statement in force.
8. ELECTRONIC SIGNATURE:
The validation of the order associated with the identification procedure constitutes a signature between the parts having even value that a handwritten signature. The computerized registers are preserved like evidence of the communications, orders and payments occurred between the parts.
9. CONSERVATION OF THE DATA:
CALAIS-LINGERIE engages, under conditions reasonable of safety, to preserve its registers, orders and invoices on a reliable support so as to constitute a faithful and durable copy of this filing in accordance with article 1348 of the civil code.
10. EXECUTION OF THE ORDER:
The order accepted by CALAIS-LINGERIE under the conditions of sale previously defined, will be carried out in the 7 days. The customer will be informed by an email of the validation of his order and will be allotted to him a single number of order. This number of order references to the following data: entire amount and detail of the order, VAT and price including all taxes, as well as the amount of the expenses of delivery, the means of payment chosen by the customer, the address of invoice and the address of delivery, the identity and the references of CALAIS-LINGERIE.
11. SENDING:
The products will be dispatched in a closed and discrete packing with the address indicated by the customer. Only the regulated orders will be dispatched. CALAIS-LINGERIE reserves the right to refuse an ordering of a customer, in particular a customer with who litigation would exist. The articles are sent in colissimo. 12. DELIVERY :
For any delivery out of the French territory, and of the European Union, the customs taxes and costs of any other formality is with the exclusive load of the customer who commits himself checking the possibilities of imports of the products of the site. 13. RECEPTION OF THE PRODUCT:
The customer commits himself checking the state of the parcel and the goods on arrival of this one. In the event of damage, the customer is required to inform under 3 working days CALAIS-LINGERIE with calais-lingerie@wanadoo.fr, as well as the conveyor by the means of a complaint, deposited in doubled bloom of that of CALAIS-LINGERIE in his post office! The customer is free to make any remark on products CALAIS-LINGERIE with the customer service of CALAIS-LINGERIE with: commandes@calais-lingerie.com.
14. GUARANTEE :
In the event of nonconformity or defect of the delivered product, the customer will have into informed the customer service of CALAIS-LINGERIE by email with commandes@calais-lingerie.com. CALAIS-LINGERIE is committed curing the problem as soon as possible. CALAIS-LINGERIE assumes with regard to the customer the responsibility related with the delivered products, in accordance with the regulations in force. CALAIS-LINGERIE guarantees, in accordance with the legal tendencies, the customer against any latent defect affecting the products delivered and making them unsuitable to the use, as well as detrimental consequences while resulting.
15. RETRACTATION RIGHT :
The customer has a deadline of seven working day, as from the reception of the product (data-processing indication of follow-up colissimo of the post office being taken), to turn over the article to his expenses to CALAIS-LINGERIE ZONE DES DUNES Bat C1 RUE DES OYATS 62100 CALAIS FRANCE. The products will have to be turned over, not used, labelled, and in their origin packing. The customer will have the choice then to ask one to have amount of his order except for the engaged expenses, valid one year, or product exchange with the postal expenses with his load.
16. INTELLECTUAL PROPERTY:
All texts, comments, illustrations and images reproduced on the site, published by CALAIS-LINGERIE are reserved under royalty like under intellectual property, and this for the whole world. In accordance with the code of the intellectual property, alone the private use is authorized. 17. ENTIRETY OF THE CONTRACT :
So for any reason one of these conditions previously definite was to be considered to be inapplicable, it would not affect to in no case the application of the other provisions. The latter considered to be inapplicable will be replaced by a provision nearest possible.
18. RESPONSIBILITY:
Neither CALAIS-LINGERIE, nor the customer could be held responsible for the inexecution of the order having due a case of absolute necessity out of their control, including in particular: cases of war, riot, interruption of parcel delivery, shortage, fire, earthquake, flood. The customer is responsible for the choice of his products, their conservation, and their use, by himself or a third.
19. LANGUAGE OF THE CONTRAT/ APPLICABLE LAW / PAYMENT OF THE LITIGATIONS:
The language of the contract is French. This contract is subjected to the French right. Litigations will be subjected to the competence of the French regional jurisdiction.
